What Rights - Fitness to Practice

Another nurse restored.

When you are struck off, you have to wait 5 years until you can apply to be restored to the register.  There is the possibility of appealing the strike off order, but it is a high hurdle to get over in order to be successful.  There is one other route that can be taken, but this requires a particular set of circumstances.  Usually, you will have no choice other than to wait for 5 years.

It is not, however, the case that you can wait 5 years, make your application and then automatically get re-registered.  You have to be able to persuade a panel that you are capable of safe and effective practice, and that you are a fit and proper person - this is not a straightforward exercise and unless you are terribly lucky (and as you got struck off 5 years earlier you would be wise not to rely on luck), you will need specialist advice in order to achieve the right outcome.

Today, I represented another client on such an application at the NMC.  The client was successful and now is only a return to practice course away from being able to practise as a nurse once more.

My opponent, the NMC case presenter, told me that the application was one of the best they had ever seen. I have a 100% success rate with restoration applications, and the reason for that rate is this - I know what needs to be said and done and I advise my clients not to submit their applications until I say they are ready to be submitted.

If you have 'served' your 5 years or are close, then you are in the right place for advice and representation on your restoration application.  Today's happy client has left a testimonial to tell you more about their experience - I think we've all gone home happy tonight!
