Hear this...

Today's interim order application hearing demonstrated again the value of seeking early advice.  My client, a hearing aid dispenser, had been referred to the HCPC for a criminal caution of a sexual nature.  Once the Investigating Committee had decided the case should go to a final panel hearing, the HCPC responded by making an application for an interim order to suspend my client's practice.  Usually, the HCPC will give you 7 days notice of the interim order hearing - my client got hold of me straight away and supplied me with his case documents by email the same day, which allowed us to make best use of that week and produce two important documents. At the hearing today, the HCPC made lengthy submissions to support their application; however we were well prepared to counter all submissions made and to make much more persuasive submissions as to why no order was necessary.  The panel accepted our submissions and so my client is able to continue working whilst their case is being investigated.

Whilst it is still possible to make meaningful representations at even shorter notice, having the full 7 days made all of the difference in a difficult case.

My client certainly doesn't regret the time and money spent!
